Terms of Service

These Terms of Service ("Terms") govern your access to and use of Dyaspora Maket (the "Platform"), operated by Dyaspora Maket ("we", "us", "our"). By creating an account, listing products, or browsing the Platform, you agree to be bound by these Terms.

Dyaspora Maket is a marketplace platform that connects independent buyers and vendors. We provide listing, discovery, search, communication and (where enabled) checkout infrastructure. We do not manufacture, source, inspect, ship, or fulfill any product or service offered by vendors.

Dyaspora Maket is not a party to any transaction between a buyer and a vendor and does not act as a buyer's agent, seller's agent, broker, escrow agent, insurer, shipper, or guarantor. All sales contracts are formed directly between the buyer and the vendor.

To the maximum extent permitted by applicable law, Dyaspora Maket is not responsible for:

• The quality, safety, legality or accuracy of any product or service listed;
• Shipping delays, lost packages, customs issues, or delivery failures;
• Vendor fraud, misrepresentation, non-delivery or no-shows;
• Direct payment disputes between buyers and vendors processed off-platform;
• The quality, timeliness or outcome of any service performed by a vendor;
• Any damages, loss or harm arising from a buyer-vendor interaction.

Buyers transact with vendors at their own discretion and risk. We strongly encourage buyers to review vendor profiles, ratings and listing details carefully before purchasing.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform. You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate, current and complete information and to keep it up to date.

Vendors are solely responsible for their listings, pricing, inventory, fulfillment, taxes, customer service and compliance with applicable laws. Buyers are responsible for reading listings, asking questions, and complying with import/export rules in their jurisdiction.

Vendors may purchase subscription plans (e.g. Pro, Premium) and one-time paid features (e.g. featured listing promotions). Subscriptions renew automatically until cancelled. Cancelled subscriptions remain active until the end of the paid period; downgrades take effect at the end of the current billing period. See our Refund Policy for details.

Featured listing promotions are charged immediately upon checkout and require admin approval before going live. If a promotion is rejected for policy reasons, the unused portion will be refunded.

Your use of the Platform is also governed by our Acceptable Use Policy. Violations may result in listing removal, suspension or termination of your account.

The Platform, its branding, logos, copy and software are owned by Dyaspora Maket and protected by intellectual property laws. See our Intellectual Property Policy. You retain ownership of the content you upload and grant us a worldwide, non-exclusive, royalty-free licence to host, display and promote it on the Platform.

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, Dyaspora Maket and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Platform. Our aggregate liability for any claim shall not exceed the greater of (a) the fees you paid us in the 12 months preceding the claim or (b) USD 100.

You agree to indemnify and hold Dyaspora Maket harmless from any claim, demand, loss or damages, including reasonable legal fees, arising from your content, your use of the Platform, or your violation of these Terms.

We may suspend or terminate your account at any time as described in our Account Termination Policy. You may close your account at any time from your account settings.

These Terms are governed by the laws of the jurisdiction in which Dyaspora Maket is established, without regard to conflict-of-laws rules. Disputes between users should first be raised through our Dispute Policy.

We may update these Terms from time to time. Material changes will be communicated by email or via an in-app notice. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
